Understanding the Basics of Consumer, Financial and Personal Injury Law

Sorting Out Legal Disputes During Or After A Construction Project

While it is never fun to have to get involved in a legal dispute, when concerns arise on a construction project or about specific aspects of the project, you may not have any other option than to get a lawyer involved to help sort things out. In many cases, the issues might not be intentional but if there is a breach of contract of any kind, you have to be ready to answer for that. Sometimes the answer comes in the courtroom, not the boardroom.

Disputes Arising Out Of Deadlines

One of the biggest disputes that can involve construction litigation, like that from Wright, Ponsoldt & Lozeau, Trial Attorneys, are missed deadlines. When a project has a specific timeline attached to it, you need to be sure that you can meet it before you sign the contract. There are times when things happen along the way that make it hard, but if there is a deadline in the contract, it is possible that the contractor will have a consequence to deal with. If you are trying to fight a missed deadline because of something you could not control (ie. supplier issues or material shortages) getting a lawyer involved to help is important.

Design Changes Or Flaws

In many cases, the way a building is designed can make or break it for the customer. If they are not happy with the design or some aspect of the building as it is going up, they may seek litigation to try and lower the cost or seek to have the design changed. If this happens only on, the contractor can make some layout or design changes but after the building is nearly finished, it because difficult and costly and fighting those changes could cause the project to stop and litigation to start.

Using The Legal Tools Your Have

Most contracts spell out the litigation process before the project starts so taking the time to read and understand this is important. In many cases, litigation is not required at all but when large projects and large amounts of money are involved, disagreements can become much harder to deal with. If one party is faced with losing money or having something like this affect their reputation in the business environment, it is very common to want it worked out so that both parties get what they need or want. What that is might be different for each of them, but that is where the lawyers come in; representing the best interests of their client and working for a positive outcome from all parties involved.
